US Court Mandates Release of Abrego Garcia from Immigration Custody

A federal judge has ruled the immediate discharge of Kilmar Abrego Garcia from immigration custody, concluding his continued detainment lacks legal authority.

"Since his release after erroneous imprisonment in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis wrote in her order.

The case stems from a erroneous removal to El Salvador earlier this year, which US authorities later acknowledged was an mistake. After his return to the United States to answer human smuggling allegations, he was held in immigration detention.

In her decision, the court noted that the authorities does not have a valid removal order, which prevents them from removing Mr. Abrego Garcia "at this time."

The legal proceedings center on disputed claims. While the former administration contends that Abrego Garcia is a member of the MS-13 gang, he categorically disputes this allegation.

He has also pleaded not guilty to the conspiracy charges, which are part of a ongoing criminal case in Tennessee.
